DEPOSITION OF JUAN CARLOS PADIAL

So, sir, you’re familiarity with the allegation was simply having reviewed the documents, correct?

A. Yes.

Q. You do not, in fact, have any personal knowledge of any damage that BLI suffered as a result of any of the defendant’s conduct?

A. No, I did not.

Q. So this is not a statement or affirmation by you that there is any such connection between any of the defendant’s conduct and any damage?

A. That is correct.

Q. Specifically, you don’t know of anything, that is conduct by Mr. Gomez Lopez, that he did or did not

cause any damage to BLI, correct?

A. That’s correct.

Q. Then you go on in the sentence to refer to assertions made by some of the defendants that the alleged losses are merely contingent and potential. Again, that’s language that was drafted by the lawyers?

A. Yes, it is.

Q. Do you know, sitting here today, what that means?

A. I think at the time — you’re talking about specifically to these transactions?

Q. Well, why this language is used here in this clause?

A. At that time I guess the thought was that we would be paid on these transactions. So, therefore, they were contingent and the loss was a potential loss, not that it was a real loss.
